The scope of work under the contract is to manage, operate and maintain a security system in and around the premises of EOBI properties i.e. EOBI House G-10/4, EOBI Guest House G-6/4 and Crown Plaza F-7, round-the-clock, without any break, 24 hours a day throughout the period of the contract.
The Service provider shall be required to visualize the threat and formulate a plan to meet the security requirement of the building and its occupants. The plan would incorporate all reasonable precautions to ensure that the employees of all owner/tenant organizations, their visitors, vehicles, the plant equipment, the premises and other interests and assets of the property remain safe and sound at all times.
The scope of work shall include but shall not be limited to the following major responsibilities.
5.2 TERMS AND CONDITIONS
5.2.1 Security Supervisor age should not be more than 55 years.
5.2.2 ELIGIBILITY OF SECURITY GUARD.
5.2.3 PLACE OF DUTY
As specified by Employer’s Representative. Place of duty may be as per Section V – 5.1 of the Bidding documents, however, successful bidder may be required to send additional manpower to other sites of the Employer, on same quoted bid rates, as per requirements and formal instruction of Employer.
5.2.4 DURATION OF SHIFT DUTIES.
Round the clock per day shifts duties for Security Personnel, shall be in compliance to Rules and Regulation of Government of Pakistan.
5.2.5 SELECTION OF SECURITY GUARD.
The Security Guard in no way would be considered as Employer’s employee and no claim whatsoever would be entertained in this respect. In the event of any serious complain by the employer against any Security Guards, a suitable replacement will be provided within 24 hours.
5.2.6 PROVISIONS AND DEPLOYMENT OF MANPOWER
The provision and deployment of security guards would be based on the requirements of the building. The following minimum manpower would be provided by the Services Provider which may be subject to change at any subsequent stage, at the discretion of the EMPLOYER.
The Security Services shall be carried out on the basis of two shifts per day. The shift timings as well as the strength of staff for each shift shall be as under.

5.2.7 IDENTIFICATION OF SERVICES PROVIDER ’S EMPLOYEES
The Services Provider shall arrange the identification cards for his employees at its own. The specimen of the card shall be approved by the Employer’s Representative.
5.2.8 POLICE VERIFICATION
The Services Provider shall submit police verification from Special Branch and area police station for all guards / supervisors employed by him for performance of services under this contract.
5.2.9 MEDICAL FITNESS CERTIFICATE
The Services Provider shall submit medical fitness certificate of all guard / supervisor employed by him for performance of services under this contract, if required by the Employer.
5.2.10 WEARING OF UNIFORMS
While being present within the premises of the Building in connection with the rendering of security management services all the employees of the Services Provider shall always wear proper and clean uniforms (approved by the EMPLOYER’S REPRESENTATIVE) to be provided to them by the Services Provider at his own cost. For the purpose of identification, the uniforms shall carry prominently the name of the Services Provider & name of the Security Guard.
5.2.11 MAINTENANCE OF DAILY ATTENDANCE REGISTERS
The SERVICES PROVIDER shall maintain daily attendance register of its employees and workers engaged in providing security management services. This attendance register shall be submitted each day to the EMPLOYER’S REPRESENTATIVE at any such time which may suit the employer, which will be subject to verification by physical head count. The Services Provider will compile a monthly summary on the basis of attendance record and get it certified from the EMPLOYER’S REPRESENTATIVE. The summary will be attached with the monthly bill of the SERVICES PROVIDER .
5.2.12 PENAL DEDUCTIONS FOR SHORT ATTENDANCE AND LACK OF SATISFACTORY PERFORMANCE
The EMPLOYER’S REPRESENTATIVE shall have full authority to make penalty deductions from the Services Provider’s monthly bills if and when the Services Provider is not able to provide the required numbers of manpower at site or when his performance is not satisfactory. The deduction shall be made at the following rates:
a) In case of Short attendance 1.5-day basic wage per absentee.

5.2.13 COMPLAINT REGISTERS
The SERVICES PROVIDER shall be required to maintain a complaint register in order to record the complaints of the building users as well as the response of its staff in attending to those complaints. The register will be submitted to the EMPLOYER’S REPRESENTATIVE as and when required and on quality basis.
3.2.14 PERFORMANCE OF THE SERVICES PROVIDER
The performance of the SERVICES PROVIDER will be judged both in respect of quality of services as well as the availability of equipment and the presence of the SERVICES PROVIDER ’S staff at the site for rendering of services as per the contract.

Following is the guidance for Dispute Resolution
Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract unless they otherwise agree that the Authority shall pay the Bidder any monies due to the Bidder.
Arbitrator’s fee:
The fee shall be specified in Pak Rupees, as determined by the Arbitrator, which shall be shared equally by both parties.
Appointing Authority for Arbitrator:
By the Mutual Consent or in accordance with the provisions of Arbitration Act, 1940, in case the parties fail to reach a consensus on the name of sole arbitrator, any party may submit an application to the Chief Justice Islamabad High Court for appointment of sole arbitrator. The Chief Justice IHC may appoint a former judge of any High Court or Supreme Court as the sole arbitrator to resolve the dispute between the parties.
Rules of procedure for arbitration proceedings:
Any dispute between the Authority and a Bidder who is a national of the Islamic Republic of Pakistan arising in connection with the present Contract shall be referred to adjudication or arbitration in accordance with the laws of the Islamic Republic of Pakistan including Arbitration Act 1940, however above provision shall prevail in referring the case to the Arbitrator.
Place of Arbitration and Award:
The arbitration shall be conducted in English language and place of arbitration shall be at Islamabad. The award of the arbitrator shall be final and shall be binding on the parties.

It agrees that any contract, right interest, privilege or other obligation or benefit obtained or procured as aforesaid shall, without prejudice to any other right and remedies available to GoP under any law, contract or other instrument, be voidable at the option of GoP.
Notwithstanding any rights and remedies exercised by GoP in this regard, [Name of Supplier] agrees to indemnify GoP for any loss or damage incurred by it on account of its corrupt business practices and further pay compensation to GoP in an amount equivalent to ten time the sum of any commission, gratification, bribe, finder's fee or kickback given by [Name of Supplier] as aforesaid for the purpose of obtaining or inducing the procurement of any contract, right, interest, privilege or other obligation or benefit in whatsoever form from GoP.

Important Note: The Bidder shall strictly follow all specified cost components, calculations, and requirements and enter them in the Financial Bid Table in the prescribed sequence. Any omission, misplacement, or incorrect entry shall be the sole responsibility of the Bidder.
The Bidder shall quote the monthly cost per individual security personnel under each applicable cost component. The quoted rates shall be applied to the manpower specified in Sub-Clause 5.2.6 of Section - V (Schedule of Requirement/TOR).
