The Service Provider shall supply all cleaning materials, and consumables, in the quantities indicated in Form 02: Schedule of Prices, required for the proper execution of the Services. The Cleaning Material will be required by the Service Provider at the site for fulfillment of the contract. The Service Provider should take cognizance of and agree to the fact that the submission of this list does not in any way relieve them of the obligation to provide to the satisfaction of the EMPLOYER the cleaning equipment and all other necessary items required for the execution of the Services.1.  GENERAL

NOTE:
4.        CLEANING MATERIALS & CONSUMABLES
The Service Provider shall supply all cleaning materials, and consumables in the quantities indicated in Form 02: Schedule of Prices, required for the proper execution of the Services.
5.        PLANTATION:
The following shall form the Scope of Service under the contract.
The Service Provider shall be responsible for:
Maintenance of existing plants/landscaping at fixed locations in and around the building, as per details provided hereunder.
The Services Provider shall ensure that all the existing plants are located at fixed positions either in or outside of the building and are well maintained in their good shape and healthy conditions. If any of those plants are destroyed or damaged due to any negligence or lack of proper care in maintaining the same the Service Provider shall replace the same with a healthy plant of the same type and size failing which the EMPLOYER’S REPRESENTATIVE shall have the right to deduct the cost of the damaged plant from the monthly bill of the Services Provider. The decision of the EMPLOYER’S REPRESENTATIVE in this regard shall be final.
6.        FAÇADE CLEANING
The Services shall also include Facade Cleaning Services, including cleaning of external building facades, glass facades, windows, cladding and other designated external surfaces using appropriate methods, tools, equipment, access arrangements and safety measures. The cleaning chemicals, materials, tools, equipment, machinery, access equipment and other consumables specifically required for facade cleaning shall be provided by the Employer, whereas the Service Provider shall provide the required trained manpower, supervision, and PPE for proper and safe execution of the facade-cleaning works.
7.         MAINTENANCE OF DAILY ATTENDANCE REGISTERS
The SERVICES PROVIDER  shall maintain daily attendance register of its employees and workers engaged in providing security management services. This attendance register shall be submitted each day to the EMPLOYER’S REPRESENTATIVE at any such time which may suit the employer, which will be subject to verification by physical head count. The Services Provider will compile a monthly summary on the basis of attendance record and get it certified from the EMPLOYER’S REPRESENTATIVE. The summary will be attached with the monthly bill of the SERVICES PROVIDER .Â
8.        PENAL DEDUCTIONS FOR SHORT ATTENDANCE AND LACK OF SATISFACTORY PERFORMANCE
The EMPLOYER’S REPRESENTATIVE shall have full authority to make penalty deductions from the Services Provider’s monthly bills if and when the Services Provider is not able to provide the required numbers of manpower at site or when his performance is not satisfactory. The deduction shall be made at the following rates:
a)   In case of Short attendance                   1.5-day basic wage per absentee (On any day).
9.        COMPLAINT REGISTERS
The SERVICES PROVIDER  shall be required to maintain a complaint register in order to record the complaints of the building users as well as the response of its staff in attending to those complaints. The register will be submitted to the EMPLOYER’S REPRESENTATIVE as and when required and on quality basis.
10.      PERFORMANCE OF THE SERVICES PROVIDER
The performance of the SERVICES PROVIDER  will be judged both in respect of quality of services as well as the availability of equipment and the presence of the SERVICES PROVIDER ’S staff at the site for rendering of services as per the contract.

Following is the guidance for Dispute Resolution
Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract unless they otherwise agree that the Authority shall pay the Bidder any monies due to the Bidder.
Arbitrator’s fee:
The fee shall be specified in Pak Rupees, as determined by the Arbitrator, which shall be shared equally by both parties.
Appointing Authority for Arbitrator:
By the Mutual Consent or in accordance with the provisions of Arbitration Act, 1940, in case the parties fail to reach a consensus on the name of sole arbitrator, any party may submit an application to the Chief Justice Islamabad High Court for appointment of sole arbitrator. The Chief Justice IHC may appoint a former judge of any High Court or Supreme Court as the sole arbitrator to resolve the dispute between the parties.
Rules of procedure for arbitration proceedings:
Any dispute between the Authority and a Bidder who is a national of the Islamic Republic of Pakistan arising in connection with the present Contract shall be referred to adjudication or arbitration in accordance with the laws of the Islamic Republic of Pakistan including Arbitration Act 1940, however above provision shall prevail in referring the case to the Arbitrator.
Place of Arbitration and Award:
