Following is the guidance for Dispute Resolution
Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract unless they otherwise agree that the Authority shall pay the Bidder any monies due to the Bidder.
Arbitrator’s fee:
The fee shall be specified in Pak Rupees, as determined by the Arbitrator, which shall be shared equally by both parties.
Appointing Authority for Arbitrator:
By the Mutual Consent or in accordance with the provisions of Arbitration Act, 1940, in case the parties fail to reach a consensus on the name of sole arbitrator, any party may submit an application to the Chief Justice Islamabad High Court for appointment of sole arbitrator. The Chief Justice IHC may appoint a former judge of any High Court or Supreme Court as the sole arbitrator to resolve the dispute between the parties.
Rules of procedure for arbitration proceedings:
Any dispute between the Authority and a Bidder who is a national of the Islamic Republic of Pakistan arising in connection with the present Contract shall be referred to adjudication or arbitration in accordance with the laws of the Islamic Republic of Pakistan including Arbitration Act 1940, however above provision shall prevail in referring the case to the Arbitrator.

TENDER DOCUMENTS FOR OUTSOURCING OF SECURITY SERVICES UNDER POSTMASTER GENERAL METROPOLITAN CIRCLE, KARACHI
The interested firms are invited to offer a complete package on the basis of per guard per month wages for a period of One (01) year with full responsibility of security arrangements i.e. uniformed armed guards for around the clock duty. The following information/documents must be attached with tender forms.
1 Valid attested copy of N.T.N Certificate of the Firm/Company.
2 Attested copy of latest NOC issued by the Ministry of Interior Government of Sindh.
3 List of the Firms/Government Organizations at which security services are being provided by the firm/company along with date of enlistment.
4 Proof of Annual Inspection of Arms & Ammunition by respective authorities under Ministry of Interior, Government of Pakistan.
5 List of arms/security equipment in use of firm/security guards.
6 Affidavit that the company has not been involved in litigation against any
Government Department nor it has been black listed by any Government Department.
7 Bank Statement of last one year of the company/firm.
8 Attested copy of CNIC of the owner.
9 Proof Sales Tax Registration Certificate should be attached with the bid and return of Sales Tax for last year should also be provided.

11 The Postmaster General Metropolitan Circle, Karachi reserves the right to accept or reject any one or all the tenders as per Rule 33 (i) of PPRA Rule 2004.The decision of Postmaster General will be final and binding upon all firms and will not be challengeable in any court of law.
12 Only one acceptable rate should be offered keeping in view the minimum wages fixed by the Government, including all taxes, with contribution of EOBI and Social Security (ESSI).
13 The word “Tender of Security Guards” should be written outside the cover.
14 The Earnest Money Rs.100,000/- (Rupees One Hundred thousand only) in shape of Bank Draft, in favor of Postmaster General Metropolitan Circle, Karachi should be attached (in original) with the tender application which is refundable in case of disqualify of the bid. If the tender is won but failed to provide the services/take over the work as per offered rate and agreed terms and conditions by the company/firm, the earnest money will be forfeited.
15 Incomplete application or a bid submitted without earnest Money will not be entertained.
16 The successful bidder will have to sign an agreement with the department. It will have to assume the responsibilities of security of the GPOs/Post Offices immediately after signing the agreement.
17 The lowest successful bidder party/firm shall provide complete profile of security guards to be deployed before signing the agreement. Besides this, the company / firm will have to provide complete detail of security guards along with police verification / antecedent and army discharge certificate at the time their deployment.
18 The Guards so provided be Ex-Servicemen from Army, Police or Ranger equipped with security equipment i. e Guns, Metal Detectors and Scanner etc. having good physics required training to discharge their duties efficiently and must be within the age of 50 years.
19 The second party shall furnish a performance guaranty / security money, which shall not exceed ten percent of the contract amount as per provision made in Rule-39 of Public Procurement Rules, 2004 and pledged in the name of the Postmaster General for due fulfillment of the terms of the Agreement. The same can be released after expiry of Agreement.
