The Service Provider shall provide 24/7 security services for the EOBI Hotel & Business Complex Project Lahore including protection of the premises, guests, staff, visitors, vehicles and property. Un-Armed Security Guards.1. SCOPE OF WORK
The scope of work under the contract is to manage, operate and maintain a security system in and around the premises of EOBI properties i.e. EOBI Building 66-M.A. Johar Town, EOBI Mall and Mix Use Development Project Mouza Sejpal and EOBI Hotel & Business Complex Lahore, round-the-clock, without any break, 24 hours a day throughout the period of the contract.
The Service provider shall be required to visualize the threat and formulate a plan to meet the security requirement of the building and its occupants. The plan would incorporate all reasonable precautions to ensure that the employees of all owner/tenant organizations, their visitors, vehicles, the plant equipment, the premises and other interests and assets of the property remain safe and sound at all times.
The scope of work shall include but shall not be limited to the following major responsibilities.
2 TERMS AND CONDITIONS
2.1 Security Supervisor age should not be more than 55 years.
2.2 ELIGIBILITY OF SECURITY GUARD.
2.3 PLACE OF DUTY
As specified by Employer’s Representative. Place of duty may be as per Section V – 5.1 of the Bidding documents, however, successful bidder may be required to send additional manpower to other sites of the Employer, on same quoted bid rates, as per requirements and formal instruction of Employer.
2.4 DURATION OF SHIFT DUTIES.
Round the clock per day shifts duties for Security Personnel, shall be in compliance to Rules and Regulation of Government of Pakistan.
2.5 SELECTION OF SECURITY GUARD.
The Security Guard in no way would be considered as Employer’s employee and no claim whatsoever would be entertained in this respect.
In the event of any serious complain by the employer against any Security Guards, a suitable replacement will be provided within 24 hours.
2.6 PROVISIONS AND DEPLOYMENT OF MANPOWER
The provision and deployment of security guards would be based on the requirements of the buildings. The following minimum manpower would be provided by the Services Provider which may be subject to change at any subsequent stage, at the discretion of the EMPLOYER.
The duty schedule, including the shift timings and deployment/strength of staff, shall be determined by the EMPLOYER according to operational requirements.

2.7 IDENTIFICATION OF SERVICES PROVIDER ’S EMPLOYEES
The Services Provider shall arrange the identification cards for his employees at its own. The specimen of the card shall be approved by the Employer’s Representative.
2.8 POLICE VERIFICATION
The Services Provider shall submit police verification from Special Branch and area police station for all guards / supervisors employed by him for performance of services under this contract.
2.9 MEDICAL FITNESS CERTIFICATE
The Services Provider shall submit medical fitness certificate of all guard / supervisor employed by him for performance of services under this contract, if required by the Employer.
2.10 WEARING OF UNIFORMS
While being present within the premises of the Building in connection with the rendering of security management services all the employees of the Services Provider shall always wear proper and clean uniforms (approved by the EMPLOYER’S REPRESENTATIVE) to be provided to them by the Services Provider at his own cost. For the purpose of identification, the uniforms shall carry prominently the name of the Services Provider & name of the Security Guard.
2.11 MAINTENANCE OF DAILY ATTENDANCE REGISTERS
The SERVICES PROVIDER shall maintain daily attendance register of its employees and workers engaged in providing security management services. This attendance register shall be submitted each day to the EMPLOYER’S REPRESENTATIVE at any such time which may suit the employer, which will be subject to verification by physical head count. The Services Provider will compile a monthly summary on the basis of attendance record and get it certified from the EMPLOYER’S REPRESENTATIVE. The summary will be attached with the monthly bill of the SERVICES PROVIDER .
2.12 PENAL DEDUCTIONS FOR SHORT ATTENDANCE AND LACK OF SATISFACTORY PERFORMANCE
The EMPLOYER’S REPRESENTATIVE shall have full authority to make penalty deductions from the Services Provider’s monthly bills if and when the Services Provider is not able to provide the required numbers of manpower at site or when his performance is not satisfactory. The deduction shall be made at the following rates:
a) In case of Short attendance 1.5-day basic wage per absentee On any day.
2.13 COMPLAINT REGISTERS
The SERVICES PROVIDER shall be required to maintain a complaint register in order to record the complaints of the building users as well as the response of its staff in attending to those complaints. The register will be submitted to the EMPLOYER’S REPRESENTATIVE as and when required and on quality basis.
2.14 PERFORMANCE OF THE SERVICES PROVIDER
The performance of the SERVICES PROVIDER will be judged both in respect of quality of services as well as the availability of equipment and the presence of the SERVICES PROVIDER ’S staff at the site for rendering of services as per the contract.
2.15 SPECIAL OBLIGATIONS OF THE SERVICES PROVIDER
The Service Provider shall provide comprehensive security services at EOBI Building, 66-M.A. Johar Town, EOBI Mall and Mixed-Use Development Project, Mouza Sejpal, and EOBI Hotel & Business Complex, Lahore, on a 24/7 basis throughout the contract period. The scope shall include deployment of trained security personnel, protection of buildings, occupants, assets and equipment against theft, sabotage and other security threats, control of entry/exit and material movement, maintenance of security logs and registers, monitoring of parking and visitors, prevention of unauthorized activities, fire-hazard vigilance, and immediate reporting of incidents to the Employer’s Representative.
The Service Provider shall deploy the required manpower as directed by the Employer, maintain appropriate uniforms, licensed weapons (where applicable), safety equipment, attendance records and complaint registers, and ensure proper shift handovers, discipline and satisfactory performance. All guards and supervisors shall meet the prescribed eligibility, age, physical fitness, training and police-verification requirements. The Service Provider shall ensure timely payment of wages in accordance with applicable minimum-wage requirements, registration with EOBI, submission of wage-disbursement certificates, and compliance with applicable labour laws. The Employer may revise manpower strength, duty schedules and deployment locations according to operational requirements, impose deductions for short attendance or unsatisfactory performance, and require replacement of personnel where necessary. The Service Provider shall also be responsible for proven losses or damages attributable to its personnel and shall maintain confidentiality of all information relating to the Employer and its properties.

Following is the guidance for Dispute Resolution
Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract unless they otherwise agree that the Authority shall pay the Bidder any monies due to the Bidder.
Arbitrator’s fee:
The fee shall be specified in Pak Rupees, as determined by the Arbitrator, which shall be shared equally by both parties.
Appointing Authority for Arbitrator:
By the Mutual Consent or in accordance with the provisions of Arbitration Act, 1940, in case the parties fail to reach a consensus on the name of sole arbitrator, any party may submit an application to the Chief Justice Islamabad High Court for appointment of sole arbitrator. The Chief Justice IHC may appoint a former judge of any High Court or Supreme Court as the sole arbitrator to resolve the dispute between the parties.
Rules of procedure for arbitration proceedings:
Any dispute between the Authority and a Bidder who is a national of the Islamic Republic of Pakistan arising in connection with the present Contract shall be referred to adjudication or arbitration in accordance with the laws of the Islamic Republic of Pakistan including Arbitration Act 1940, however above provision shall prevail in referring the case to the Arbitrator.
Place of Arbitration and Award:
The arbitration shall be conducted in English language and place of arbitration shall be at Islamabad. The award of the arbitrator shall be final and shall be binding on the parties.

2. The following documents shall be deemed to form and be read and construed as part of this Contract, In the event of any ambiguity or conflict between the Contract Documents listed below, the order of precedence shall be the order in which the Contract Documents are listed below:-
3. In consideration of the payments to be made by the Procuring Agency to the Bidder as hereinafter mentioned, the Bidder hereby covenants with the Procuring Agency to provide the Goods related services and to remedy defects therein in conformity in all respects with the provisions of the Contract.
4. The Procuring Agency hereby covenants to pay the Bidder in consideration of the provision of Goods and the remedying of defects therein, the Contract Price or such other sum as may become payable under the provisions of the contract at the times and in the manner prescribed by the contract.

[Name of Supplier] hereby declares that it has not obtained or induced the procurement of any contract, right, interest, privilege or other obligation or benefit from Government of Pakistan or any administrative subdivision or agency thereof or any other entity owned or controlled by it (GoP) through any corrupt business practice.
Without limiting the generality of the foregoing [Name of Supplier] represents and warrants that it has fully declared the brokerage, commission, fee etc. paid or payable to anyone and not given or agreed to give and shall not give or agree to give to anyone within or outside Pakistan either directly or indirectly through any natural or juridical person, including its affiliate, agent, associate, broker, consultant, director, promoter, shareholder, sponsor or subsidiary, any commission, gratification, bribe, finder's fee or kickback, whether described as consultations fee or otherwise, with the object of obtaining or inducing the procurement of a contract, right, interest, privilege or other obligation or benefit in whatsoever form from GoP, except that which has been expressly declared pursuant hereto.
