Specifications / Requirements:
Scope 1. National Insurance Company Limited (NICL), working under the administrative control of Ministry of Commerce and owned by the Government of Pakistan, hire services for Rodent control on regular basis and Termite, Fumigation/ Pest Control Services on quarterly basis for NICL’s self-occupied areas i.e. Ground Floor (Basement), PBX Room & Reception area of 1st Floor, 2nd Floor, 3rd Floor, 4th ( L/W), 5th Floor, 6th (R/W) & 12th Floor at NICL building, Karachi. Details are as follows: Rodent control services on a regular basis. Termite, Fumigation/pest control services quarterly basis. 2. Materials used shall be non-toxic or low-toxicity and safe for indoor office environments. Special care shall be taken to ensure that substances do not pose any risk to: Pregnant women Elderly people Persons with respiratory conditions Individuals with medical implants (e.g. pacemakers) 3. Contractor should work on INTEGRATED PEST MANAGEMENT (IPM) TECHNIQUES to minimize the risk. Use Physical and Chemical Control Methods to control the Rodents & Pest Infestation. 4. Formulation Chemicals/Medicine to be used for this work should be internationally/nationally (WHO/EPA) approved by health organization & Material Safety Data Sheet (MSDS) also required (Proof required). 5. Manage these equipment’s on weekly basis (Technical Person will manage all these equipment’s). 6. The Rodent control Chemical to be used must be harm free especially for Human beings. 7. The Contractor shall be responsible to maintain separate records, duly signed by the concerned HOD/ In-charge on weekly visit, clearly indicating minimum frequency of operation every week in a month. 8. The dead rats, other insects & reptiles should be disposed off outside the building & the place should be washed with disinfectant solution and air freshener should be used for bad smell. 9. The bidder/contractor is responsible to periodically check the rats, other insects & reptiles existence in false ceiling, A/C ducts, Sewerage lines & main holes of the building. 10. Rodent & Pest Control Treatment/Fumigation of all common areas, under the use or vacant, shall be ensured. Rodent & Pest Control Fumigation of all rooms, hall, lobbies, terraces, courtyards, parking areas, footpaths, roofs etc. 11. Execution of the said work, as assigned in the agreement. 12. Issuance of proper identity cards to the staff. 13. All workers should be in UNIFORM. A fine of Rs. 200/- per person will be charged without wearing uniform per day. 14. The contractor would provide and maintain daily consumable items insecticides/rodenticides/spray machines/cadges/Glue Traps etc. In the store of the Vendor and will utilize these items according to the requirement. 15. The Contractor shall deploy well-mannered Pest Control Operator (PCO) for weekly visits. 16. The weekly completion/ activity report & Weekly Pesticides/Rodenticides usage report will be prepared duly signed/stamped by both parties. 17. Monthly Pre & Post Analysis Report(s) and Gap Analysis Report will be share. 18. All the workers deputed by the contractor will be obligated to maintain decorum and non-compliance to which may result in imposition of penalty / fine on the contractor. 19. The entire financial liability in respect of equipment, material, workers deployed and other items shall be borne by the contractor and the office concerned will in no way be liable. 20. Contractor shall be solely responsible for redressel of grievances or resolution of disputes relating to the deployed workers. NICL shall, in no way, be responsible for settlement of such issues. 21. Accommodation, meals and refreshments for the workers would be the responsibility of the contractor. 22. Following is the guidance for Dispute Resolution
Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract unless they otherwise agree that the Authority shall pay the Bidder any monies due to the Bidder.
Arbitrator’s fee:
The fee shall be specified in Pak Rupees, as determined by the Arbitrator, which shall be shared equally by both parties.
Appointing Authority for Arbitrator:
By the Mutual Consent or in accordance with the provisions of Arbitration Act, 1940, in case the parties fail to reach a consensus on the name of sole arbitrator, any party may submit an application to the Chief Justice Islamabad High Court for appointment of sole arbitrator. The Chief Justice IHC may appoint a former judge of any High Court or Supreme Court as the sole arbitrator to resolve the dispute between the parties.
Rules of procedure for arbitration proceedings:Â
Any dispute between the Authority and a Bidder who is a national of the Islamic Republic of Pakistan arising in connection with the present Contract shall be referred to adjudication or arbitration in accordance with the laws of the Islamic Republic of Pakistan including Arbitration Act 1940, however above provision shall prevail in referring the case to the Arbitrator.
Place of Arbitration and Award:
The arbitration shall be conducted in English language and place of arbitration shall be at Islamabad. The award of the arbitrator shall be final and shall be binding on the parties.
