For conformance to specifications and performance parameters, through Prior to delivery inspection (Inspection Report by Procurement Committee / Inspection Team)
1. The Contractor will employ 21 Numbers of janitorial staff excluding the supervisory staff which should be of 18 years & above as child labor is strictly prohibited under the law. 2. The distribution of Janitorial staff in each shift shall be as per discretion of Procuring Agency i.e. NHMP Training College, however, atleast 06 Janitorial staff shall be kept in college during the night time.
3. The Contractor shall submit the monthly bill within the first 05 working days of the following month alongwith all requisite documents/reports required for processing, if the payment of bill is delayed for any reason, the bill amount shall not bear any interest.
4. 10. All janitorial staff shall wear a proper uniform bearing the contractor firm logo, proper shoes and shall display the identification cards on their uniforms issued by the college authority. The contractor shall provide minimum 02 pairs of uniforms and shoes to the janitorial staff, violation of which shall result in disciplinary proceedings under the contract.
5. All persons engaged by the contractor shall be the Contractor's own employees and they will claim no privileges from the NHMP Training College. The Contractor will be directly responsible for the administration of his employees as regards general discipline and courteous behavior however the staff shall not be rotated frequently for security reasons. The reason for changing an employee shall be communicated in writing to the college authority.
6. 12. The contractor shall be responsible to submit medical fitness certificates of the employees with test results of the contiguous diseases.
7. 13. The contractor shall be responsible to conduct regular medical tests of contiguous diseases after every 06 months and submit report to the college authority.
8. 14. No criminal record certificate /Police verification of staff employed will be submitted by the contractor. 15. The contractor shall remove all trash and garbage to the waste receptacles outside the college premises as per all applicable waste management laws/rules.

Following is the guidance for Dispute Resolution
Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract unless they otherwise agree that the Authority shall pay the Bidder any monies due to the Bidder.
Arbitrator’s fee:
The fee shall be specified in Pak Rupees, as determined by the Arbitrator, which shall be shared equally by both parties.
Appointing Authority for Arbitrator:
By the Mutual Consent or in accordance with the provisions of Arbitration Act, 1940, in case the parties fail to reach a consensus on the name of sole arbitrator, any party may submit an application to the Chief Justice Islamabad High Court for appointment of sole arbitrator. The Chief Justice IHC may appoint a former judge of any High Court or Supreme Court as the sole arbitrator to resolve the dispute between the parties.
Rules of procedure for arbitration proceedings:Â
Any dispute between the Authority and a Bidder who is a national of the Islamic Republic of Pakistan arising in connection with the present Contract shall be referred to adjudication or arbitration in accordance with the laws of the Islamic Republic of Pakistan including Arbitration Act 1940, however above provision shall prevail in referring the case to the Arbitrator.

The arbitration shall be conducted in English language and place of arbitration shall be at Islamabad. The award of the arbitrator shall be final and shall be binding on the parties.
