1. The scope of this SLA renewal covers the OEM-backed Local Vendor SLA for Network Layer 2 Manageable Switches up to 31st October 2027, and for Cisco IP Phones (models CP-8865-K9 and CP-7821-K9) up to 31st July 2030. The dates mentioned represent the End-of-Support timelines for Network Switches and Cisco IP Phones CP-8865-K9. The contract term shall commence from the date of confirmation of the SLA renewal.
2. The service encompasses regular updates for software and firmware, configuration management, and optimization to ensure smooth and secure operations.
3. The Service Provider shall be responsible for proactive lifecycle management of all network equipment covered under this SLA. This includes monitoring OEM End-of-Life (EoL) and End-of-Support (EoS) announcements and ensuring continued operability and supportability of the equipment.
4. The Proactive Lifecycle management also include regular notification to procuring entity of upcoming EoL/EoS milestones and provide recommendations for technology refresh well in advance to avoid service impact. The service provider must ensure all replacement equipment is fully covered under OEM-Backed warranty and support contracts for the remaining SLA period.
5. Round-the-clock technical support will remain available through multiple channels, including phone, email, and a dedicated web portal. The service will provide access to different levels of technical expertise, ranging from Tier 1 support for basic troubleshooting to escalation with OEM experts for complex issues. Secure remote diagnostic tools will also be employed to resolve problems efficiently.
6. The Supplier to provide on-site support and services for the entire solution as per SLA terms.
7. Comprehensive reporting and documentation will be an integral part of the SLA. Detailed logs of incidents and their resolutions, along with root cause analysis, will be maintained. Additionally, inventory and configuration management documentation will be updated regularly for accurate record-keeping.
8. Data confidentiality will be maintained at all times, with strict compliance to local data protection laws, ensuring a secure and compliant IT environment.
9. The Supplier is required to include THREE (03) YEAR PRINCIPAL backed Warranty and Vendor SLA services onsite which will adhere to the timelines and conditions defined under Service Level Agreement (SLA) Requirements.
10. OEM Support from India and Israel is not acceptable.

Liquidated Damages

Following is the guidance for Dispute Resolution
Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract unless they otherwise agree that the Authority shall pay the Bidder any monies due to the Bidder.
Arbitrator’s fee:
The fee shall be specified in Pak Rupees, as determined by the Arbitrator, which shall be shared equally by both parties.
Appointing Authority for Arbitrator:
By the Mutual Consent or in accordance with the provisions of Arbitration Act, 1940, in case the parties fail to reach a consensus on the name of sole arbitrator, any party may submit an application to the Chief Justice Islamabad High Court for appointment of sole arbitrator. The Chief Justice IHC may appoint a former judge of any High Court or Supreme Court as the sole arbitrator to resolve the dispute between the parties.
Rules of procedure for arbitration proceedings:
Any dispute between the Authority and a Bidder who is a national of the Islamic Republic of Pakistan arising in connection with the present Contract shall be referred to adjudication or arbitration in accordance with the laws of the Islamic Republic of Pakistan including Arbitration Act 1940, however above provision shall prevail in referring the case to the Arbitrator.
