| FDE intends to hire the services of Security Guard/Chowkidar from registered and eligible service provider companies/firms for ICT School/Colleges working under ambit of FDE for a period of two years, further extendible for a period of one year on satisfactory performance, as per following terms and conditions: |

| i.       Minimum Security Guard/ Chowkidar Standard: |
| a)Â Â Â Retd Armed Forces or Trained Civilian Guard. |
| b)Â Â Â Education: at least 8th Grade / Middle pass |
| c)Â Â Â Age: Guards must be 30-55 years of age |
| d)Â Â Â Fit to perform duties and not suffering from any communicable diseases. |
| e)Â Â Â 12 bore shotgun (repeater) in excellent condition. |
| f)Â Â Â Â Proof of training of guard in handling of firearms (in case of civilian guard). |
| ii.       The Service provider firm/ Company shall provide security Guard seven days a week. In case of guard's absence, the company would be bound to provide immediate replacement from reserved staff. |
| iii.       Documentation: The selected company will provide complete files of every guard that should contain verified copy of NADRA CNIC, Educational Certificate (minimum Middle preferably Matric), and experience certificate 2 Photographs, Police clearance/Character certificate. |
| iv.       Guards will remain vigilant and attentive, and exhibit professionalism while on duty. They will report all abnormalities to the administration of respective school / college where they are deployed. |
| v.       Deployment plan will be shared later on. |
| vi.       Each guard will be responsible for ensuring that the safety & security of duty site at school / college. A guard will not exceed his normal working hours as per contract. |
| vii.       In case of an emergency, the service provider firm/company must have adequate available resources and bound to provide back up on demand at desired location(s). |
| viii.       Payments will be made on a monthly basis against the services provided to the company based on approved invoices and attendance of the security guards. |
| ix.       Proper Training classes about Discipline and guest courtesy will be held by the company after 6 months |
| x.       Security Guards/Chowkidars deployed by the contractor will carry their Service Cards duly issued/attested from the contractor’s firm along with NADRA CNIC cards, whenever placed for duty or replaced. |
| xi.       The service provider firm/Company shall deploy only such guards who are physically & medically fit, have adequate training of guarding services and such trainings are refreshed at periodic intervals. |
| xii.       The service provider firm/Company will be responsible to get each guard medically examined by a registered medical practitioner. The company shall also ensure that character certificates of each guard have been verified. |
| xiii.       The successful bidder shall bound to provide needed accessories to security guards such as Arms & ammunition, Rain Coat, umbrella, whistle, torch for Night Guard. |
| xiv.       Any other scientific solution for enhancing security measures would be considered as an edge. |
| xv.       Daily attendance will be marked in the register at the point. Daily attendance sheet shall be verified by Supervisor / Security In charge (if any) & FDE |
| xvi.       The company will be responsible to introduce a guard to the person in-charge of at Respective School / college or focal person of FDE before deployment as a substitute. |
| xvii.       The service Provider shall maintain a list of reserve staff out of which replacement of removed/ absence/ left guards would be made. |
| xviii.       Guards in every Shift (12 hours) will come 15 minutes prior to the start of the next shift and in case of deployment of two guards in different shifts, the guard will not leave the station until replacement arrives. |
| xix.       The bidder shall be liable to make payment of wages to the human resource regularly and certificate to this effect will be submitted in first week of succeeding month. |
| xx.       The rates offered by the company shall be inclusive of all costs related to provision of services including but not limited to overtime charges if applicable for Security Guards / chowkidar, EOBI, Social Security charges, cost of uniform, arms, ammunition & accessories required for successful provision of required service, all direct & indirect applicable taxes / duties, providing medical care in case of on-duty injuries etc. |
| xxi.       Deployment of Staff: List showing names addresses along with the attested copies of CNIC of all employees shall be provided to FDE before deployment. Any replacement shall be intimated to Ministry and FDE in advance. The contractor will be responsible to provide the character verification from the police authorities within 10 days after award of the contract. The Contractor shall immediately replace any Security Guard / chowkidar, as and when instructed by FDE or Head of Institution concerned. |
| xxii.       The total contract period of the agreement shall be two (02) years which may be extended for subsequent year on satisfactory performance. |
| xxiii.       Company/firm will be fully responsible in case of misconduct caused by the provided / deployed security personnel and meet any losses caused as a result of such misconduct. |
| xxiv.       The bidder shall be liable to make payment of wages to the human resource regularly and certificate to this effect will be submitted in first week of succeeding month. |
| xxv.       The human resource engaged by the bidder for the execution of the contract shall not be considered or treated as the employees of Government of Pakistan, M/o FE&PT, FDE or Institution where deployed. |
| xxvi.       If a bidder is found involved in misconduct, misappropriation, fraud, cheating, theft and defalcation during the currency of the contract, he will be blacklisted and the amount of the security deposit / performance guarantee shall stand forfeited in favor of FDE / Government of Pakistan. |
| xxvii.       That during the agreement period, if the contractor intends to discontinue the service then he would be under legal obligation to issue the notice for withdrawal of the service at least 90 days in advance, failing which the payment of the remaining bills will not be released to him and security deposit / performance guarantee shall be forfeited. |
| xxviii.       In case of any conflict between the two parties, arbitration will be made where Secretary, M/o FE&PT will be final authority after personal hearing of both the parties. |
| xxix.       Under no circumstances whatsoever, the rates once approved and the acceptance thereof communicated to them shall be reviewed or enhanced upward all during the validity and currency of the contract including the extended period, if any. No application, petition, or appeal in this regard shall be entertained and considered by the procuring agency except increase in minimum wage or tax by the Government. |
| xxx.       The Contractor shall ensure that all Security Guard engaged under the contract are paid at least the minimum wages as prescribed by the Government of Pakistan |
| xxxi.       In case of increase in minimum wages and / or taxes by the Government, the bidders shall be entitled in according increase in rates. |
| All applicable licensing from the relevant departments for this service must be provided at the time of contract. |
The interested bidders will provide 381 Security Guards/Chowkidar for deployment in school/ colleges of Federal Directorate of Education Islamabad. The said deployment in Schools/ Colleges of FDE will address the issues of fool proof security of the premises.

Following is the guidance for Dispute Resolution
Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract unless they otherwise agree that the Authority shall pay the Bidder any monies due to the Bidder. Arbitrator’s fee: The fee shall be specified in Pak Rupees, as determined by the Arbitrator, which shall be shared equally by both parties. Appointing Authority for Arbitrator: By the Mutual Consent or in accordance with the provisions of Arbitration Act, 1940, in case the parties fail to reach a consensus on the name of sole arbitrator, any party may submit an application to the Chief Justice Islamabad High Court for appointment of sole arbitrator. The Chief Justice IHC may appoint a former judge of any High Court or Supreme Court as the sole arbitrator to resolve the dispute between the parties. Rules of procedure for arbitration proceedings: Any dispute between the Authority and a Bidder who is a national of the Islamic Republic of Pakistan arising in connection with the present Contract shall be referred to adjudication or arbitration in accordance with the laws of the Islamic Republic of Pakistan including Arbitration Act 1940, however above provision shall prevail in referring the case to the Arbitrator. Place of Arbitration and Award: The arbitration shall be conducted in English language and place of arbitration shall be at Islamabad. The award of the arbitrator shall be final and shall be binding on the parties. |
