Special Terms & Conditions
Â
1. The agreed number of workers as provided in Sub-clause A-2(a) shall be provided within time as defined in work order issued under the agreement.
2. The Client may ask for additional number of workers and which the Service Firm shall provide in agreed additional time those additional workers shall be billed on the same rate as provided in the Appendix-C
3. The Service Firm shall be bound to engage and include the workers which are
recommended by the Client.
4. The Service Firm shall be bound to remove the workers whom are required, by the
Client in writing, to be removed.
5. If a worker is removed from the job or leaves the job the replacement period shall be
one week.
6. The Service Firm shall be responsible for adherence and compliance of all applicable
Labor Laws for time being enforced including EOB, Social Security, Compulsory
Group life Insurance and third-party insurance.
7. It shall be the responsibility of the Service Firm to ensure that the workers provided to the Client are physically fit.
8. There will be six working days in a week.
9. There shall be 8 working hours of duty for each worker in a day.
10. All workers shall be entitled to leaves according to labour laws with due approval/authorization of their supervisor.
11. If notified by the Client the Labor Firm shall ensure the presence of workers on gazette holidays. But in case workers have to work on any of the gazette holidays their leave shall be adjusted in any of the succeeding working days.
12. The Client shall notify Standard Operating Procedures (SOPs) for calculation of
overtime and for leave management.
13. Any of the leave by any worker violating the SOP notified by the Client shall also be
deductible.
14. Without prejudice to the relaxation given in Proviso of Sub-clause A-2(b)(iii) the
overtime shall be billed as per notified SOP.
15. Verification of the particulars, reference check and record check, of the workers, shall
be the responsibility of the Service Firm.
16. Service Firm shall be responsible for the return of uniforms, tools and equipments
provided to the workers by the Client.
17. Service firm shall pay to the workers provided to the client at wage rates notified by
the Government of Pakistan or as defined by the client. The wages per month as per Govt of Punjab minimum wage rates notification or as per client defined rates for various categories of workers are as under;

Service firm shall submit proof of Payroll, EOBI, Social Security and Group Life Insurance and third-party insurance the above said salary to workers every month to get reimbursed and paid for its invoices.

Following is the guidance for Dispute Resolution
Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract unless they otherwise agree that the Authority shall pay the Bidder any monies due to the Bidder. Arbitrator’s fee: The fee shall be specified in Pak Rupees, as determined by the Arbitrator, which shall be shared equally by both parties. Appointing Authority for Arbitrator: By the Mutual Consent or in accordance with the provisions of Arbitration Act, 1940, in case the parties fail to reach a consensus on the name of sole arbitrator, any party may submit an application to the Chief Justice Islamabad High Court for appointment of sole arbitrator. The Chief Justice IHC may appoint a former judge of any High Court or Supreme Court as the sole arbitrator to resolve the dispute between the parties. Rules of procedure for arbitration proceedings: Any dispute between the Authority and a Bidder who is a national of the Islamic Republic of Pakistan arising in connection with the present Contract shall be referred to adjudication or arbitration in accordance with the laws of the Islamic Republic of Pakistan including Arbitration Act 1940, however above provision shall prevail in referring the case to the Arbitrator. Place of Arbitration and Award: The arbitration shall be conducted in English language and place of arbitration shall be at Islamabad. The award of the arbitrator shall be final and shall be binding on the parties. |
