| A minimum of five years of verified active construction experience in 132 kV or higher overhead transmission-line works is mandatory, assessed over the five years preceding the bid-submission deadline.
A single bidder shall meet the five-year requirement itself. For a two-member JV, the Lead Partner shall meet this requirement, and each member shall contribute at least one qualifying completed contract.
Count contracts for the stated works completed within the five-year period: the single bidder’s own contracts, or the combined distinct contracts of both JV members. Duplicate contracts shall count once only. Members’ years shall not be added together, and overlapping work periods shall not be counted twice.

Termination

Liquidated Damages

Identifying Defects:
The Authority reserves the right at any time to inspect the premises of the provider to inspect the goods and monitor the goods being provided.
Joint inspection and inventory at handover, with any shortage or visible damage recorded before carriage. Materials shall be checked again upon delivery to the site or designated store.
Foundations: Inspection of setting-out, excavation or piling, reinforcement and formwork before concreting; concrete quality tests and verification of completed foundations
Towers and poles: Inspection of members, bolts, alignment, verticality and tightening after erection.
Inspection of fittings and joints, conductor tension and sag, clearances, and completion of the stringing works.
Inspection of the completed line, rectification of identified defects, and all applicable electrical and commissioning tests before handover.
Insurance Certificate;
The contractor shall collect PESCO-supplied transmission line materials from the designated PESCO warehouse and transport, unload, handle and store them safely at the work site or designated site store. Delivery shall be verified against a jointly signed material handover and receipt record. The contractor shall account for the materials received, used and remaining at completion.

Notwithstanding any reference to the arbitration herein, the parties shall continue to perform their respective obligations under the Contract.
Rules of procedure for arbitration proceedings:
Any dispute between the Authority and a Bidder shall be referred to arbitration under the laws of Pakistan including Arbitration Act 1940.
Place of Arbitration and Award:
The arbitration shall be conducted in English language and place shall be Islamabad. The award shall be final and binding.

The Bidder/JV shall demonstrate construction experience during the five years immediately preceding the bid-submission deadline in works falling under the PEC specialization codes required for this procurement, namely CE-02, CE-10 and EE-05. The Bidder shall demonstrate available financial resources equal to at least 30% of the estimated contract cost, net of existing contractual commitments. In the case of a JV, the members shall collectively meet the 30% requirement. The Bidder and each JV member shall submit current bank certificates or balances, committed and unutilized credit lines, and a schedule of existing contractual commitments.
The Bidder/JV shall demonstrate successful completion or substantial completion, during the five years immediately preceding the bid-submission deadline, of at least two similar contracts for 132 kV or higher overhead transmission-line works, each having a value of not less than PKR 240,383,134. The experience shall be supported by the relevant Contract Agreement or Work Order together with a Completion Certificate, substantially completed IPC, or a certificate issued by the employer/engineer confirming the contract scope, executed value, and completion or substantial-completion status
The Bidder shall demonstrate available financial resources equal to at least 30% of the estimated contract cost, net of existing contractual commitments. In the case of a JV, the members shall collectively meet the 30% requirement. The Bidder and each JV member shall submit current bank certificates or balances, committed and unutilized credit lines, and a schedule of existing contractual commitments.
The Bidder/JV shall demonstrate an average annual construction turnover of at least 70%, calculated over the last three completed financial years. The Bidder and each JV member shall submit audited financial statements and an ICAP/Chartered Accountant certificate confirming year-wise turnover and the three-year average. A JV shall collectively meet 100% of the requirement, with the lead member meeting at least 50% and the other member at least 20%.
