Liquidated Damages

The Bidder shall submit copies of the Letter of Award/Contract Agreement, together with Completion Certificate or Taking-Over Certificate for completed works. For ongoing works, the Bidder shall submit the Contract Agreement along with the latest Interim Payment Certificate or Employer's Certificate indicating the percentage of completion. Where experience is claimed as a Joint Venture Member or Subcontractor, the relevant JV Agreement or Subcontract Agreement shall also be provided clearly indicating the Bidder's share and scope of work. |

A minimum number of similar contracts specified below that have been satisfactorily and substantially completed as a prime contractor, joint venture member, management contractor or sub-contractor in the last five (5) years and application submission deadline: 2 contracts, each of minimum value 50% of the estimated contract cost.

Non-performance of a contract did not occur as a result of contractor default during the last five (05) years. |

Pending Litigation |
Bidder’s financial position and prospective long term profitability sound according to criteria established in 3.1 below and assuming that all pending litigation will be resolved against the Bidder |

Financial Capabilities |
(i) The Bidder shall demonstrate that it has access to, or has available, liquid assets, unencumbered real assets, lines of credit, and other financial means (independent of any contractual advance payment) sufficient to meet the construction cash flow requirements estimated at 30% of the estimated contract cost for the subject contract(s), net of the Bidder's other commitments.
(ii) The Bidder shall demonstrate, to the satisfaction of the Procuring Agency/Employer, that the financial resources demonstrated under this criterion are sufficient, after accounting for ongoing and future contractual commitments, to meet the cash flow requirements of the subject contract (iii) The audited balance sheets for the last three (3) years shall be submitted. Where the laws of the Bidder's country do not require audited financial statements, the Bidder shall submit unaudited financial statements duly certified by a Chartered Accountant or other legally authorised accounting professional, together with any other financial records (such as income tax returns or annual financial reports) acceptable to the Procuring Agency/Employer, demonstrating the Bidder's financial position and long-term profitability. |

Average Annual Construction Turnover |
